本学期 JONES DAY 跨境法律律师实务课程

圆满收官啦！

2020 年秋季学期，受疫情影响，北京大学法学院携手美国众达律师事务所开设的全英文《跨境法律律师实务课程》以网络直播+录播回放的方式在线上进行。众达全球范围内的合伙人和资深律师通过网络跨越重洋，带领同学们了解前沿跨境法律律师实务问题，加深同学们对国际律所律师专业知识的理解和掌握。

今年，共有 6 所不同院校的 68 名中外学生选修本课程。

课程创新

受众扩大

今年，课程借助网络技术，扩大了受众范围，首次面向北大中国法硕士项目（LL.M. Program in Chinese Law）学生和众达律师事务所的律师开放。

形式新颖

课程借用 Webex 平台，结合北大教学网，采用了网络直播+录播回放的方式，选课学生的时间安排更灵活，并且学生可以通过反复观看录播视频来复习课程。

互动频繁

学生们可在每节课后一周内向授课律师提问，由助教统一收集问题，律师们及时、认真回答同学们提出的问题。

“Jones Day Introduction to International Legal Practice is an ideal course for people who want to know more about cross-border legal practices. Jones Day invites formidable speakers. This course is taught by veteran Partners practicing in different offices and even different jurisdictions. For instance, the speaker teaching our IP class is Mr. Anthony Insogna, a leading pharmaceutical and biotech patent attorney with nearly 30 years’ experience who represents top pharmaceutical and biotech companies as well as promising start-ups. The speaker teaching the M & A class was Mr. Ansgar Rempp. He was named a leading senior partner in M&A in JUVE's Handbook 2019, one of only 19 lawyers in Germany to be so recognized.  In addition to talking about the US law, many of the topics are introduced by both lawyers working in the US and in the Europe, providing comparative perspectives from both sides. Speakers teach different areas of legal practice based on their true practices and introduce a lot of real case studies, which are really fascinating, and substantially help our understandings of the relevant areas.”

“在开学之初，我抱着提高英语水平、了解美欧主要法律的目的，第一时间就积极报名了这门课程。经过一学期的学习，我发现我的收获远超出我的想象。本学期的授课内容横跨破产法、专利法、反垄断法、环境法、刑事诉讼法等多个领域，真正做到了纵览美欧主要法律，可谓“博”。而在每个具体专题下，资深律师或合伙人都非常用心地准备 60-70 页 ppt，力图在有限的时间内让同学们尽量深入地了解该部法律，可谓“专”。这门课让我看到了不同律师的风采，虽然他们国籍不同、年龄不同、执业领域不同、服务的客户不同，但相同的是当他们谈及自己执业领域时所散发出来的自信和魅力。这让我深受鼓舞，也让我下定决心在本课程结束后，继续刻苦精进学业，在未来执业时能成为像他们一样的专业能力强且思维敏捷的优秀律师。”

“As a Belgian exchange student from the University of Leuven (KU Leuven), I chose the online course “Jones Day: Introduction to International Legal Practice”. In Belgium, it is unknown that a law firm offers courses at a university, therefore I was very interested in following this course. Looking back, practicing law in a globally integrated law firm like Jones Day was an unforgettable experience for me. This course inspired me to discover unfamiliar areas of law and served as an excellent preparation for a career in the practice of law. Each week a different area of international legal practice was covered. These areas were covered from a Chinese, European and US law perspective by lecturers who were for example from the office in Brussels, Paris, New York, Washington and Chicago. As a consequence, I always had a very international, global feeling when I followed a class of this course.”

“The Jones Day course is colorful, brilliant, and charming. It inspires me to think globally and act locally. Why? Since the topics are dynamic. It buzzes the nexus of forces. Of course, most of us will be attorneys soon. On the one hand, we might work hard over time with paper chase. On the other hand, we may think of something bigger – anything but law. I feel the balance of those in the program. Frankly, I heard the program last year but it was a pity to miss it, since I still exchanged at Osgoode in Canada. This year, I make it comes true. What impressed me, firstly, is its global view. Based on my experience, I found we could learn more from varied jurisdictions. Especially there is a shock between civil law and common law. “We need to bridge it,” international lawyers said. Thus, diverse academic and professional backgrounds contribute to our wide-ranging ideas. Secondly, what we learn is practical. The counsels’ experience spills into the classroom and expands our horizon. It is the real way, the pave of hardworking and accountability. Thirdly, some topics are in my favor, like IP, M&A. Some are what I met for the first time, such as environmental law. It is new, so it is fresh. It is green, so it is clean. Do you know? It enlightens me to think about the analogy between data governance and discharge governance. What a fusion!”

“虽然因为疫情原因今年未能进行线下授课，但课程内容与质量却未缩水，是一次超乎预期而极有收获的学习之旅。课程给予了我法律英语方面的提升。课堂采用全英文授课，而课程材料采用中英双语，既促进了课堂理解，也方便了课后的继续学习。虽无现场翻译，但课后提供课程录像，使我有机会对未理解处反复观看。其次，这次课程让我获得了对“跨境业务”这一概念最直观、最全面也最深入的了解。由顶尖律所的合伙人亲自授课，展示了跨境业务各领域的荦荦大端，但律师们没有局限于浮光掠影的入门级介绍，而对实务中的细节与重要问题也进行了启发与点拨，俨然是将学生视做即将从事跨境业务的初级律师进行培养，在带来挑战的同时也带来了知识与思维上的锻炼。最后，得益于Jones Day的全球化优势，课程对同一个业务领域分别讲授在不同法域中的实务操作，譬如分别讲授了欧盟法与美国法下的对限制竞争行为的认定，分别讲解了美国与德国的并购业务流程，同学们可以在比较中对某一法律问题有更立体、多元的认识，这也是本课程的特色之一。”
